Eyelash lengthener with new formula is about to reach the market

What’s your experience with eyelash lengtheners?

The Jan Marini cosmetic company is about to re-enter the market for eyelash lengtheners that it exited after the Food and Drug Administration seized its supplies of Age Intervention Eyelash in November.

The FDA said that the previous Marini product, which contained bimatoprost, a type of prostaglandin drug, could cause blindness if used in conjunction with a glaucoma drug also containing a prostaglandin.

Marini and other companies selling eyelash lengtheners also faced lawsuits from Irvine-based Allergan, which accuses them of infringing its patents covering use of prostaglandins. Allergan makes Lumigan, a glaucoma medication containing a prostaglandin that some doctors prescribe for eyelash-lengthening, although that is not an FDA-approved use.

Marini says the new $160 Marini Lash contains a “non-prostaglandin” peptide blend that has been tested on about 100 people in the United States and abroad, the Health Blog of the Wall Street Journal reported. As of today, it is not yet on sale.

Dermatologist Dr. Lorrie Klein of Laguna Niguel prescribes Lumigan for patients who want longer eyelashes. Klein says:

It works in 100% of my patients who have tried it. A few have tried the Jan Marini product and RevitaLash also, but they say that Lumigan grows their lashes faster and longer.

Klein says she’s unaware of any other chemical, including any peptide blend, that stimulates eyelash growth.

Allergan is reportedly testing its own version of Lumigan as a potential eyelash-lengthening product.

Gloria Estefan’s resort and spa to open with little fanfare

Singer-celebrity Gloria Estefan’s sleek Costa d-Este Beach Resort is to open to guests about June 16 - but without fanfare, hotel officials said.

In the next few days the county Building Department expects to clear the way for the opening by approving that the newly-constructed hotel is structurally ready for use, department Operations Coordinator Kery Jones said Wednesday.

“We look forward to its opening,” he said. “We need more hotels.” However, it could be late September or early October before there is an official grand opening of the $50 million, five-story beach-front facility.

Some people have already reserved rooms that have an introductory rate of $189. Rates will rise to $249 beginning Oct. 1 through Dec. 19. The resort has 90 guest rooms, four suites and a large spa.

Rooms feature marble floors, teak headboards and even iPod docking stations, along with wireless internet access.

Details are still being worked out for the opening of the resort’s 85-seat restaurant Oriente that will be under the management of Cuban-American chef David Rodriguez.

The Ocean Drive hotel is built around the core of a five-story hotel purchased for $12.5 million after it was heavily damaged by hurricanes in 2004. The overall architecture was changed, creating a modernist style unique to the hotel.

The showers are round and made of limestone. Large circular opening, of random sizes, punctuate the building’s stark exterior.

Estefan co-owns the 2.4-acre hotel with her husband, Emilio Estefan. They have a home in the Vero Beach area. Benchmark Hospitality International is managing the resort that will employ 70 people.

Costa d-Este Beach Resort will have “keen style and multi-cultural sophistication,” according to the resort’s publicist. Service will be “discreetly attentive.

Buffalo Grive spa expands services despite trustees debate

The Buffalo Grove village board has begrudgingly given approval for expanded services at a spa run by the park district, but not before several trustees expressed disappointment.

The measure passed unanimously, but several trustees made it known that was only due to the way the agreement was written and not because they agreed with the proposal.

Some board members on Monday said they felt the park district was infringing on the profits of local businesses by competing with them.

The park district requested the addition of waxing and eyelash-tinting services at Vitality Spa.

However, Trustee Jeff Braiman said the village runs a restaurant, which competes with others in the area.

“We do similar things. We have a golf course,” he said.

Park district Director Mike Rylko said other medically run clinics offer similar services and the spa wants to be on the same level as them.

The spa already offers therapeutic massage, manicure and pedicures.

He said the clients of the spa, which is run by Northwest Community Healthcare employees and is owned by the district inside the Fitness Center, also asked for the additional services.

“It shouldn’t be a double standard,” he said, referring to the village’s restaurant.

However, Trustee Bruce Kahn, who abstained from voting on the issue, said the spa was billed as therapeutic.

“I didn’t like it when it first came before us. I don’t like it any more now,” he said. “It’s not about therapy; it’s about a revenue stream.”

He said more residents have commented about this issue to him than any other in the past month and he said it’s not fair that the park district competes against businesses that have a spa as their only livelihood.

“People have asked me, ‘So what’s next? Hair cuts?’” he said on Tuesday.

Two spa owners made their case for not allowing the expansion of services in May when the issue was first up for discussion.

Marilyn Wagner, owner of Best Salon & Spa in Buffalo Grove, said the park district hasn’t affected her business yet but that waxing is a significant portion of how she makes her money.

Warren Michaels, owner of Michael Thomas Hair Salon & Day Spa in town, said he and other spa owners don’t have the option to diversify like the park district does.

The issue riled Kahn so much that he resigned his Fitness Center membership earlier in the week because he didn’t want to support the park district if it was challenging local businesses.

“I understand the therapeutic nature of massage, but when it starts coming into manicures and pedicures, I just didn’t agree with them,” he said. “I don’t think they should be in direct competition with 20-plus other businesses in town.”

Trustee DeAnn Glover agreed, saying she was extremely disappointed in the park district for continually asking for more services. She said, in her opinion, the request may comply with the special use, but it doesn’t go with the spirit of the agreement.

“This was all supposed to be therapeutic,” she said. “I thought it was stretching it for nails.”

Glover said that from now on, she would be more critical of any requests coming from the district.

In the end, the trustees conceded that the issue was of zoning and not of regulating the business the park district chooses to go into.

“We need to adhere to the requirements of special use,” Braiman said. “I think it does comply.”

Medical spa rules to get a makeover

Bill would toughen penalties against absentee oversight

Sherry Deppermann spent two months reading up on a new, state-of-the art form of liposuction. And after identifying a local medical spa that offered it, she checked with the state medical board to see whether the doctors in charge had ever been disciplined.

“I’m a nurse, so I probably did more research than most people,” she said. “I think there are a lot of people out there who shouldn’t be doing these procedures, and most clients don’t know who’s going to be working on them and what their training is.”

Deppermann’s diligence is unusual, but officials say it’s a good idea since a loophole in state law has led to alleged abuses at some medical spas.

A QUESTION OF OVERSIGHT

In California, as in many states, a licensed physician or surgeon must be the majority owner of a medical spa. The law even requires minority stake holders to work in a health-related field.

But under current rules, the doctor in charge need not be present when a medical spa is performing certain services. They merely must be “reachable” during the procedure, said Candis Cohen, a spokeswoman for the Medical Board of California.

As a result, some medical spas have physician oversight on paper, but the doctors in charge spend little or no time in the offices. Lawmakers in several states are addressing this safety concern.

A bill pending in the California legislature would strengthen penalties against such absentee oversight. Introduced by Alan Nakanishi, R-Lodi, Assembly Bill 2398 would expand penalties — which are now usually fines — to include license revocation.

The bill also would give an attorney general the option of filing criminal charges. Currently, any discipline is the sole jurisdiction of the state medical board.

But attorney David Shane says failing to require the supervising doctor’s presence at the medical spa means the bill doesn’t go far enough.

The physician’s name “lends an aura of respectability, but in reality, it’s misleading” if the doctor isn’t there, he said.

“What does ‘reachable’ mean, exactly?” he said. “In this day and age, everyone’s reachable if they have e-mail or a cell phone.

“That’s such a big loophole that it doesn’t really provide the care that consumers expect.”

Shane represents a 57-year-old Mill Valley man who is suing The Laser Center of Marin. His client alleges his skin became so hypersensitive to light after a botched laser hair removal treatment that he now suffers severe pain in the sun. There was no doctor at the facility to handle the complications of the treatment, Shane said, and the injury seems to be permanent.

The patient, Dom Martin, declined to comment and The Laser Center of Marin could not be reached late Friday.

MEDICAL SPAS COMING AROUND

The bill’s proposed changes to the Business and Professions Code regulating the state’s medical facilities has yet to win broad support from the medical spa industry.

“A lot of this is dermatologists and plastic surgeons trying to corner the market on medical spas because they don’t like the competition,” said Hannelore Leavy, executive director of International Medical Spa Association. “Some states are trying to restrict ownership to certain kinds of doctors, but if the person is properly licensed and trained, there’s no reason why they can’t perform these services.”

The association hopes to reduce the need for new laws by developing a national accreditation for medical spas, Leavy said. They hope the new system will be implemented in the next year or two, she said.

But Dr. M. Christine Lee, who is lobbying for the bill’s passage through a trade organization, says a lot of “misinformation” about the bill has “scared medical spa owners.”

“What opponents don’t realize is this doesn’t create a new law, it just increases the ability to enforce existing law,” said Lee, who runs a medical spa in Walnut Creek and teaches dermatologic surgery at the University of California, San Francisco.

That was enough to sway Jina Pappas, a nurse practitioner who runs Aescala Skin Care, a cosmetic division that High Grove Medical Center opened more than three years ago in its downtown building.

“I do agree that doctors should be accessible and aware of what’s happening at medical spas,” she said. “Some of these treatments are serious medical procedures. I do a lot of laser tattoo removals, and they work by burning off the skin, so it heals like a burn.”

Bakersfield’s Dr. Jason Helliwell has already seen the benefits of close oversight.

“We used to offer our cosmetic and clinical services in two different locations, but we consolidated them at a new building in April,” he said. “It was for both safety and convenience.”

Helliwell co-owns Advanced Women’s Health Center on Brimhall Road with his wife, fellow OB/GYN Dr. Siniva Kaneen. About 20 percent of their clinic’s work is now cosmetic services such as the Smart Lipo he performed Friday on Deppermann, he said.

“My wife and I do all the Smart Lipo ourselves, and we use an R.N. (registered nurse) and physician assistant who are specially trained for the Botox injections and laser treatments and things like that that aren’t surgical,” he said. “But if anything goes wrong, we’re right down the hall, which makes me a lot more comfortable.”

SAFETY TIPS

Candis Cohen, spokeswoman for the Medical Board of California, says prospective patients should:

Find out the name of the medical spa’s director and check to see if the Medical Board of California has disciplined that person before undergoing treatment.

Find out who will be actually performing the treatment, and check that person for any disciplinary actions on their record. Also investigate their background and training, including how many times they have performed the procedure.

The medical board can also tell you which types of aestheticians, therapists and health care practitioners are licensed to administer a given treatment.

Visit before the procedure, if possible, and look around. Is it clean? Does it look sterile?

Trust your gut. If you’re not totally and completely satisfied with the answers to your questions, go somewhere else.

Botox maker prepares new drug to lengthen eyelashes

Botox maker Allergan announced today that it has completed tests of its eyelash growth drug and plans to apply within a few months for approval to sell it.

The Food and Drug Administration is likely to approve the treatment, bimatoprost, sometime next year, Irvine-based Allergan said.

A similar formulation from Allergan is already being prescribed by some doctors for patients who want longer eyelashes. That drug, Lumigan, is marketed for treatment of glaucoma, but doctors can prescribe it for non-FDA-approved uses.

The new Allergan drug would be available by prescription in the United States. Patients apply it directly to the base of the eyelashes, unlike Lumigan eyedrops.

Scott Whitcup, executive vice president of research and development, said some patients have found that Lumigan eyedrops produce discoloration of the iris or of skin around the eyes — side effects that will be kept to a minimum by using an eyelash applicator, the Wall Street Journal (subscription required) reported.

Allergan has sued several companies that have sold similar eyelash-lengthening treatments, accusing them of infringing the company’s patents. Among them is the Jan Marini cosmetic company, which halted sales of its eyelash lengthener after the FDA seized its supplies, and is preparing to market a different formulation.

Allergan predicted it could sell as much as $500 million of the new drug worldwide each year. That compares to $3.7 billion in estimated sales of mascara per year.
